DOT & FMCSA Resources
Simplified for Drivers
Understanding your rights, your responsibilities, and your next steps shouldn’t require a law degree. These resources make the process clear, direct, and easy to navigate.
Whether you’re trying to confirm what a SAP actually does, check your Clearinghouse record, or understand what the DOT expects before you can return to work, the links below will help.
We’ve also added short summaries to explain what each page means — and how CDL SAP Solutions can guide you through it.
Official Federal Resources
Here are the key government pages that outline how the Return-to-Duty process works. Each link opens in a new tab.

This is where your violation record is stored and where your SAP will record your progress. You’ll need to log in here to designate your SAP once you’ve chosen one.
DOT 49 CFR Part 40 Regulations
The official federal regulation defining how SAP evaluations must be handled, what steps are required, and how employers must respond.
ODAPC (Office of Drug & Alcohol Policy & Compliance)
Explains the DOT’s policy and provides official SAP guidance and FAQ documents for drivers and employers.
Return-to-Duty Overview – FMCSA
A plain-language summary of the testing and reinstatement process under FMCSA authority.
Where employers and drivers manage compliance data, designate SAPs, and access Clearinghouse status updates.
What Each Step Means in Plain English
DOT rules can be intimidating — here’s what they actually mean for you.
-
This is your first formal step. You’ll talk with a licensed professional who’s qualified under DOT regulations. They’ll determine what kind of education or treatment you need before you can test again.
-
This step fulfills the federal “rehabilitation” requirement. For some drivers, it’s a short course; for others, it’s limited counseling. We’ll guide you to the right provider and help you track progress.
-
After completing your program, you’ll meet again with your SAP. If you’ve met all requirements, they’ll approve you for a Return-to-Duty test.
-
Once your SAP signs off, your record in the FMCSA Clearinghouse is updated — that’s what allows employers to see you’re eligible to work again.
-
This is your final negative test result confirming compliance. After that, you can officially drive again.
Why Using a DOT-Qualified SAP Matters
Not all evaluators are DOT-qualified. Using someone who isn’t officially recognized by the Department of Transportation can cause major delays and even prevent you from legally returning to work.
Our SAPs meet every federal requirement and report your progress directly through the FMCSA Clearinghouse — ensuring you’re fully compliant from day one.
